The Terms and Conditions set out below are the terms on which you book and partake in any Cruise or activity which is booked for you by Tapanese.com Pty Ltd trading as Dolphin and Whale Watch Booking Agency or through our online site www.loveps.au
1. Introduction
1.1 These terms and conditions govern your use of the services provided by Tapanese.com Pty Ltd, T/as Dolphin and Whale Watch Booking Agency, for booking land and water-based activities
1.2 By making a booking through our platform or services, you agree to be bound by these terms and conditions.
2. Booking Process
2. 2.1 To book an Activity, customers must provide accurate and complete information, which must include a valid email address.
2.2 All bookings are subject to availability and confirmation.
2.3 The Agent reserves the right to refuse or cancel a booking for any reason, including but not limited to errors in pricing or availability, or if the customer fails to meet certain health, age, or fitness requirements
3. Payment Terms
3.1 Full payment is required to secure a booking.
3.2 Payments are processed through our secure payment gateway.
3.3 Prices are subject to change without notice until the booking is confirmed.
3.4 In case of a cancellation (see “Cancellation Policy”), a refund may be available, subject to the terms outlined below.
4. Customer Responsibilities
4.1 Customers must arrive on time for their scheduled Activity. Late arrivals will result in a forfeit of the booking without a refund.
4.2 Customers must adhere to all safety guidelines and instructions provided by the operator of the Activity.
4.3 Certain Activities may require customers to meet specific health, fitness, or age requirements. It is the Customer’s responsibility to ensure they meet these requirements.
4.4 The Customer is responsible for ensuring they have the appropriate clothing, equipment, or gear for the Activity.
5. Health & Safety
5.1 The Customer acknowledges that participating in land and water-based activities may involve certain risks.
5.2 The Agent or Activity providers will inform customers of the potential risks, but customers should exercise their own discretion when participating.
5.3 Customers must inform the Agent of any medical conditions or injuries that may affect their ability to participate in the Activity.
5.4 All safety equipment provided by the Activity operator must be worn and used properly.
6. Cancellations & refunds
6.1 Refunds will be provided according to the following policy:
More than 48 hoursbefore the Activity: Full refund minus any applicable fees.
Less than 24 hours before the Activity: No refund.
6.2 The Agent reserves the right to cancel an Activity for reasons beyond control (e.g., extreme weather, natural disasters, etc.). In such cases, the Customer will receive a full refund or an alternative date for the Activity.
6.3 Subject to directors/agents discretion
7. Changes to Bookings
7.1 The Customer may request to change the date or details of a booking, subject to availability and a change fee if applicable.
7.2 The Agent reserves the right to make changes to a booking or Activity, including changes to timing, location, or activity type, if necessary.
8. Privacy and Data Protection
8.1 The Agent will process the Customer’s personal information in accordance with applicable data protection laws.
8.2 The Customer agrees that their personal information may be shared with third-party service providers as necessary to fulfill the booking.
9. Dispute Resolution
9.1 Any disputes arising under this Agreement will first be attempted to be resolved through informal negotiations.
9.2 If a resolution cannot be reached, the dispute may be referred to binding arbitration or mediation as specified by local jurisdiction laws.
10. Miscellaneous
10.1 The Agent reserves the right to amend these Terms and Conditions at any time. The updated terms will be posted on the website and will apply to all bookings made after the update.
Moonshadow TQC T & C's
The Terms and Conditions set out are the terms on which you book and travel on any cruise operated by Moonshadow TQC Pty Ltd trading as Moonshadow TQC.
Booking & Cancellation Policy
Standard Cruises:
100% cancellation charge within 24 hours of departure time
A travel voucher or refund with more than 24 hours’ notice
Pre booked catered cruises:
100% cancellation charge within 24 hours of departure time
50% cancellation charge within 48 hours of departure time
A travel voucher or refund with more than 48 hours’ notice
Any amendments to bookings will incur a $10 administration fee.
Tickets are non-transferable and non-refundable unless authorised by MSTQC Cruises
Scheduled Cruises (Shared)
Standard Cruises –1.100% cancellation charge within 24 hours of departure time
2.A travel voucher or refund with more than 24 hours’ noticeAny amendments to bookings will incur a $10 administration fee.Tickets are non-transferable and non-refundable unless authorised by MSTQC Cruises
Pre booked catered cruises:
1. 100% cancellation charge within 24 hours of departure time
2. 50% cancellation charge within 48 hours of departure time

Terms & Conditions of Travel and Risk Warning
Terms & Conditions of Travel
The passenger acknowledges that during the cruise the vessel will be and will remain under the absolute control of the company, and that the direction and control of the vessel and its crew is at all times the sole responsibility of the Master of the vessel.
Moonshadow TQC reserves the right to refuse entry of a passenger on the vessel. It is also at the Master’s sole discretion to require a passenger to disembark the vessel.
Moonshadow TQC reserve the right to cancel or abandon the cruise either prior to or during the cruise, if the Company or Master of the vessel considers that the cancellation is necessary for reasons of weather or in the interest of the safety and well-being of the vessel, its passengers and crew. The Company will not be held liable for any loss or expense incurred by the passengers caused by such substitution or cancellation.
Moonshadow TQC does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control, or are not preventable by reasonable diligence on our part including but not limited to; war, civil disturbance, fire, flood, unusually severe weather, acts of God, acts of Government or of any authorities, or failure of machinery (including vessel engines) or equipment or industrial action.
Please note smoking is not permitted on any of our cruises.
Please be aware minimum passenger numbers can apply for cruises.
Risk Warning
Care is taken to ensure your safety whilst on board this vessel. However, be warned that there are inherent risks by being aboard any vessel including, but not limited to, movement of the vessel, unpredictable sea conditions, unfamiliar design features such as stairs, coamings and water on decks, slides, boomnets, ancillary equipment used and/or from the vessel etc.
Entry onto this vessel is at your own risk. Neither the owner, Master, nor any members of the crew will be liable for any injury to passengers, or damage to passengers property, however occurring.
Fares and itinerary are always subject to variation without notice.
Moonshadow TQC Pty Ltd reserves the right to cancel or vary the cruise specified and reserves the right to refuse to carry any passenger without stating any specific reason.
Once on board a Moonshadow TQC Pty Ltd vessel all persons are under the authority of the vessel’s Captain and Company Management, and are expected to conduct themselves in a socially acceptable manner. The law is clear about the “Responsible Service of Alcohol” and licenced venues are entitled to refuse service to people who are intoxicated, quarrelsome or disorderly. Moonshadow TQC Pty Ltd reserves the right to return to dock and disembark any disorderly passengers without refund.
Passengers must not bring any alcoholic beverages or illegal substances onto the vessel. ID may be required to purchase alcoholic beverages.
These terms are an integral part of the contract between passengers and Moonshadow TQC Pty Ltd. When your booking/ticket is confirmed, it will be deemed at all times that you have read, understood and accepted the conditions hereof, and agreed to the terms herein contained.
Gift Cards
Terms & Conditions of Gift Vouchers
Gift vouchers are of a monetary value only and are not allocated to a specific product.
Prices and timetables are subject to change without notice.
All gift vouchers are valid for 3 years from date of purchase.
Gift voucher bookings are only confirmed upon full payment.
Gift vouchers are non-refundable and not exchangeable/redeemable for cash.
Gift vouchers are non-transferable unless approved by Moonshadow TQC/Aquamarine Adventures
The validity date of gift vouchers cannot be extended
A $10 amendment fee may apply to cover administration costs for any booking amendments.
Imagine Cruises T & C's
The Terms and Conditions set out are the terms on which you book and travel on any cruise operated by Big Cat South Pacific Holidays Pty. Ltd trading as Imagine Cruises.
General Policy for all cruises
All cruises are quoted in Australian Dollars and inclusive of Goods & Services Tax (GST).
All cruises are non-smoking this includes e-cigarettes.
At the discretion of the Vessel’s Master and Owner cruises may be terminated or passengers removed from vessel due to antisocial or disorderly behaviour. If water police are required to be called, this will be at the passenger’s own expense.
High heeled shoes, including wedges, are not permitted onboard.
Prams and strollers are permitted onboard.
All cruises (unless otherwise stated) will depart from Dock C D’Albora Marina, Teramby Road Nelson Bay.
Boarding commences 15 minutes prior to departure time, failure to board the vessel at this time will result in cancellation of your booking without refund.
Imagine Cruises is not suitable for guests in wheelchairs/motorised wheelchairs, or guests with limited mobility. Guests are required to manage 6 stairs to board the vessel and step across a level plane to board Envision.
Imagine Cruises are bound by the NSW liquor act and must abide by the guidelines for the responsible service of alcohol during all cruise operations. BYO alcohol is not permitted onboard the boat.
Imagine Cruises have the right to request disembarkation or deny a passenger boarding the vessel due to a guest showing signs of intoxication of drugs or alcohol for the safety of staff and other passengers.
Gift Vouchers are valid for 3 years from date of purchase, they are non-refundable and only valid on Imagine Cruises.
This Company reserves the right to cancel due to insufficient bookings. Every effort will be made to ensure the cruise goes ahead however at times there may be short notice of cancellation.
Imagine Cruises reserves the right to cancel, abandon or vary any cruise due to adverse weather conditions. The company will not be held liable for any loss or expense incurred by passengers.

Sails will be hoisted at the discretion of the Master and is ultimately weather dependent.
NO passenger is entitled to any particular seat; all seating is at the discretion of the Master.
Scheduled Cruises Booking Policy
All cruises must be paid in full online or via phone before boarding except by prior arrangement.
Child is aged 4 – 14 years, all children must be accompanied by an adult when onboard the vessel.
Family tickets are valid for 2 Adults and 2 Children between the ages of 4-14 years old.
Concession rates are available for full time students, seniors or pensioners; upon boarding concession cards must be sighted. Failure to show a concession card might mean the guest is liable for the cruise fare difference.
Guests holding a Companion Card travel at the child price. Bookings can be made over the phone or in the office. Upon boarding companion cards must be sighted. Failure to show card may result in full fares applying..
If you are a holder of a return cruise voucher, (free return), bookings must be made directly with the office for your return cruise. Return vouchers are valid for 18 months from date of issue.
Cancellation Policy
Imagine Cruises have the right to cancel a cruise for any reason, including bad weather or insufficient numbers. Should Imagine Cruises cancel a cruise, passengers will be offered to reschedule, to put booking on hold until you have a new date or offered a full refund.
Should you wish to cancel or reschedule your booking outside of 24 hours of your travel date you must provide this in writing to info@imaginecruises.com.au where our staff can provide a full refund or reschedule your cruise.
Should you wish to cancel or reschedule your booking inside of 24 hours of your travel date you must provide this in writing to info@imaginecruises.com.au. At this time, you will ONLY be allowed to reschedule your cruise, NO Refunds will be issued.
A $10 administration fee may be applied for changes and/or cancellations, this is at Imagine Cruises management discretion.
Please email: info@imaginecruises.com.au with your booking number which will read IM00xxxx for public cruises to advise us of any requested changes.

Passengers travel at their own risk. Whilst all care is taken to ensure the safety of our passengers, Big Cat South Pacific Holidays Pty. Ltd. accepts no responsibility for any injury, damage or loss of property caused whilst aboard the vessel or during any cruise.
